IntroductionMOVING TIME ("Provider," "we," "us," or "our") operates as an independent service provider offering relocation assistance and logistical support ("Services") in the state of Florida. By engaging with MOVING TIME, accessing our Services, or utilizing any resources provided by us, you ("Client," "you," or "your") agree to be bound by these Terms of Service ("Terms"). These Terms constitute a legally binding agreement between you and MOVING TIME.
2. Scope of Services2.1
Service Description:
- MOVING TIME provides non-contractual assistance with packing, loading, transporting, and unloading personal or commercial items.
- Services are rendered on a "best-effort" basis with no guarantees of professional standards, timeliness, or regulatory compliance.
2.2
Exclusions:
- Transport of hazardous materials, firearms, perishables, or items requiring special permits.
- Storage of items beyond 24 hours.
- Handling of items exceeding 500 lbs without prior written authorization.
2.3
Third-Party Involvement:
- MOVING TIME may engage independent helpers or subcontractors. These individuals are not employees, agents, or representatives of MOVING TIME.
3. Client Obligations3.1
Full Disclosure:
- Client must provide a written inventory of fragile, high-value, or irreplaceable items (e.g., antiques, electronics, artwork). Failure to disclose voids all liability.
3.2
Preparation & Safety:
- Ensure all items are securely packed, labeled, and free of pests or pre-existing damage.
- Provide safe, unobstructed access to pickup/delivery locations, including parking and elevator access.
3.3
Legal Compliance:
- Client is solely responsible for securing permits, HOA approvals, or building access.
- MOVING TIME is not liable for fines, penalties, or disputes arising from Client’s failure to comply with local regulations.
4. Payment Terms4.1
Fee Structure:
- Quotes are estimates only. Final fees adjust for actual labor, time, or delays caused by Client.
- A 50% non-refundable deposit is required to secure booking.
4.2
Accepted Payment Methods:
- Cash, Zelle, Venmo, or Cash App labeled as "personal transactions." Credit cards incur a 5% surcharge.
4.3
Late Payments:
- Balances unpaid after 24 hours accrue 10% weekly interest.
- MOVING TIME reserves the right to retain possession of items until payment is resolved.
4.4
No Refunds:
- All payments are final. Partial or unsatisfactory work may be remedied at MOVING TIME’s discretion.
5. Liability Limitations & Risk Allocation5.1
Assumption of Risk:
- Client acknowledges:
- Items may be transported in unmarked, non-commercial vehicles.
- Services involve non-professional laborers and equipment.
- Participation is voluntary and at Client’s sole risk.
5.2
Excluded Liabilities:
- MOVING TIME is not liable for:
- Pre-existing damage, wear/tear, or concealed defects.
- Acts of God (e.g., hurricanes, floods), civil unrest, or road closures.
- Third-party actions (e.g., theft, vandalism, traffic accidents).
- Emotional distress, lost profits, or indirect/consequential damages.
5.3
Liability Cap:
- Total liability for any claim is capped at $100 USD or 50% of fees paid (whichever is lower).
6. Dispute Resolution6.1
Mandatory Arbitration:
- All disputes resolved via binding arbitration in Boward County, Florida, under AAA Commercial Rules.
- Client waives rights to class actions, jury trials, or court litigation.
6.2
Governing Law:
- Florida law governs these Terms, excluding conflicts of law principles.
6.3
Costs:
- Client bears 75% of arbitration fees.
7. Cancellation & Force Majeure7.1
Cancellation by Client:
- 48+ hours notice: Deposit forfeited.
- <48 hours notice: 100% of estimated fees charged.
7.2
Cancellation by MOVING TIME:
- We may cancel due to safety concerns, inclement weather, or Client fraud. Deposit refunded minus a 10% administrative fee.
7.3
Force Majeure:
- Not liable for delays/cancellations caused by pandemics, government actions, labor strikes, or vehicle breakdowns.
8. IndemnificationClient agrees to defend, indemnify, and hold harmless MOVING TIME, its personnel, and affiliates from:
- Third-party claims (e.g., property damage, injuries).
- Fines, penalties, or legal fees arising from Client’s negligence.
9. Privacy & Data Handling9.1
Collected Data:
- Name, contact information, move details, and payment records.
- Data is stored for 60 days post-service, then securely destroyed.
9.2
Data Sharing:
- Shared only with laborers directly involved in your move.
- Disclosed if legally required (e.g., subpoenas, court orders).
9.3
No Security Guarantees:
- MOVING TIME uses basic digital tools (e.g., SMS, email) with no encryption warranties.
10. General Provisions10.1 Entire Agreement: These Terms supersede all prior discussions. Amendments require written agreement.
10.2 Severability: Invalid clauses do not void remaining Terms.
10.3 Survival: Liability waivers, indemnification, and arbitration clauses survive termination.
ACKNOWLEDGMENT OF TERMSBy engaging MOVING TIME, Client confirms:
- They have read, understood, and voluntarily agreed to these Terms.
- They waive all claims not reported in writing within 24 hours of service completion.
